1. Agreement and eligibility
These Terms of Service (the "Terms") govern your use of the Ovina mobile application and related pages (together, the "Service"). References to "Ovina," "we," "us," or "our" mean the provider of the Service.
You must be legally capable of entering into these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you.
2. What Ovina provides
Ovina is a creative keepsake tool. It lets you import or capture a photo, arrange it in a template, add titles or notes, scan text, use dictation, generate a stylized image, save work in an album, mark favorites, and export completed images.
Ovina uses a local sign-in state and does not require a password or a server-hosted user account. Features that use artificial intelligence, App Store purchases, Apple speech recognition, or system sharing depend on third-party services and an internet connection where applicable.
3. Your content
You retain ownership of the photos, text, voice input, and other material you provide ("User Content"). You give Ovina a limited, non-exclusive permission to process User Content only as needed to operate the features you choose, including local editing, AI image generation, text recognition, storage on your device, and export.
You represent that you have the rights and permissions needed to use your User Content. Do not submit content that violates another person's privacy, publicity, copyright, trademark, or other rights.
You are responsible for reviewing your keepsakes before saving, sharing, publishing, or relying on them.
4. AI-generated output
When you choose AI generation or remote text scanning, Ovina sends relevant images and prompt text to third-party AI services as described in the Privacy Policy. AI output may be inaccurate, incomplete, unexpected, or similar to content generated for other users.
- Do not treat AI output as professional, medical, legal, financial, or safety advice.
- Do not assume that output is unique or eligible for copyright protection in every jurisdiction.
- You must review output and ensure that your use complies with applicable law and third-party rights.
- AI models and availability may change without notice.
To the extent permitted by law, Ovina does not claim ownership of your generated keepsakes. Your rights in AI-generated output may vary under applicable law and the terms of the AI provider.
5. Ink credits and App Store purchases
Ovina offers one-time, consumable in-app purchases that add virtual "ink" credits. There are no subscriptions or automatic renewals in the current version of the app.
- Payments are processed by Apple through the App Store. Apple controls payment authorization, taxes, regional pricing, receipts, and refunds.
- Ink credits are a limited license to use eligible features inside Ovina. They are not money, have no cash value, and cannot be transferred, sold, or redeemed outside the app.
- Displayed prices may vary by storefront, currency, and tax. The App Store purchase sheet shows the amount that applies to your transaction before confirmation.
- Ink is deducted when Ovina successfully produces a keepsake, including a local fallback result when remote AI is unavailable. A cancelled or unsuccessful generation that produces no result does not spend ink.
- Because ink packs are consumable, completed purchases generally cannot be restored like non-consumable products. Pending transactions may be completed automatically after an interruption.
- Ink balance and transaction history are stored locally. They may be lost if you delete your Ovina data, delete your local Ovina account, uninstall the app without an available device backup, or move to another device.
Refund requests are handled under Apple's policies. Requesting or receiving a refund does not create a right to retain related virtual credits.
6. Acceptable use
You may use Ovina for lawful personal creative purposes. You may not:
- create, upload, or share unlawful, abusive, exploitative, deceptive, or rights-infringing content;
- use a person's image or personal information without appropriate permission;
- attempt to bypass payment, credit, security, rate, or technical controls;
- reverse engineer, disrupt, overload, scrape, or gain unauthorized access to the Service, except where applicable law expressly allows it;
- use the Service to distribute malware or facilitate fraud, harassment, or impersonation; or
- use AI output in a way that misleads others about authenticity or origin where disclosure is legally required.
7. Ovina ownership and license
Ovina and its software, interface, templates, graphics, branding, and other provider-created materials are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the app on Apple devices that you own or control, as permitted by the App Store terms.
Except for your User Content and rights expressly granted here, no rights are transferred to you.
8. Availability and updates
We may update, add, remove, suspend, or discontinue features to maintain security, comply with law, respond to third-party service changes, or improve the Service. We do not promise that every feature, template, AI model, or third-party integration will always be available.
You are responsible for maintaining a compatible device, supported version of iOS, sufficient storage, and any network access needed to use online features.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
To the maximum extent permitted by law, Ovina will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, content, credits, profits, or opportunities; or harm caused by third-party services, AI output, device failure, or your sharing of content.
Nothing in these Terms excludes rights or liability that cannot lawfully be excluded. Consumer protection laws in your jurisdiction may provide additional rights.
10. Sign out, deletion, and termination
You may stop using Ovina at any time. Signing out clears the local session state but preserves your local creative data. Choosing "Shred Account" deletes local profile fields, keepsakes, favorites, settings, ink balance, and the local ledger. The app retains local anti-duplication flags needed to prevent a repeated first-use grant.
We may limit access to the Service if necessary to address misuse, security, legal requirements, or material violations of these Terms.
11. Changes to these Terms
We may revise these Terms as the Service or applicable requirements change. The effective date at the top identifies the current version. Continued use after updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
12. Contact and App Store terms
For questions about these Terms or the Service, email torrenik04091999@outlook.com. For purchase authorization, billing, or refund issues, contact Apple Support.
Your use of the iOS app is also subject to applicable Apple Media Services and App Store terms. If these Terms conflict with mandatory App Store terms, the mandatory App Store terms control for that issue.
